1. Acceptance of Terms
By accessing and using the OrderQuik platform, whether through our mobile application, web application, or in-restaurant table system via QR code/PIN, you agree to be bound by these Terms and Conditions in their entirety. If you do not agree with any of these terms, please do not use our services.
These terms apply to all platform users, including customers, franchise owners, managers, kitchen staff, and branch personnel.
2. Description of Service
OrderQuik is a SaaS (Software as a Service) restaurant franchise management and digital ordering platform that provides the following features:
- Digital ordering: Customers can browse menus, customize items with options and extras, add products to their cart, and place orders from the mobile app, web app, or directly from a restaurant table using a QR code and PIN.
- Real-time order tracking: Users can track their order status through the stages: pending, received, preparing, ready, and delivered.
- Electronic payments: Integration with PayPal for online payments, plus configurable payment methods per franchise (cash, card, etc.).
- Menu management: Categories, items with bilingual descriptions (English/Spanish), promotional pricing, per-branch availability, option groups, and customizations.
- Table system: In-restaurant table access via QR code and 6-digit PIN with automatic 3-hour expiration, table and seat assignment.
- Promotions and news: Promotional banners, automatically applied discounts, and a restaurant news and announcements system.
- Tips: Configurable tipping system with suggested percentages, custom tips, and a zero-tip option.
- Franchise subscriptions: Subscription plans (Freemium, Basic, Pro, Premium) with recurring billing through PayPal.
- Accounting and daily closures: Sales reports, payment method breakdowns, expense tracking, and cash register management.
- Technical support: Support ticket system with categories, priorities, and resolution tracking.
3. User Accounts
To use OrderQuik, you may need to create an account by providing personal information such as your name, email address, phone number, and password. You are responsible for:
- Maintaining the confidentiality of your login credentials (username, password, table PIN).
- All activities that occur under your account.
- Notifying us immediately of any unauthorized use of your account.
- Providing truthful and up-to-date information.
Table users (QR/PIN access) have temporary sessions that automatically expire after 3 hours. The access PIN is single-use and linked to a specific branch, table, and seat.
We reserve the right to suspend or delete accounts that violate these terms or exhibit suspicious activity.
4. Orders and Purchasing Process
When placing an order through OrderQuik:
- All orders are subject to availability and confirmation by the restaurant.
- Displayed prices are set by each restaurant/franchise and may change without notice, including promotional prices with validity dates.
- Applicable taxes are automatically calculated based on the rate configured by the branch or franchise.
- Tips are optional and configurable according to each establishment's policies.
- Item customizations (extras, modifications) may incur additional charges.
- The subtotal, taxes, tip, and total are clearly displayed before confirming the order.
5. Payments
OrderQuik facilitates payment processing through the following methods:
- PayPal: Online payments are processed through PayPal. By using this method, you also agree to PayPal's terms of service.
- Other methods: Each franchise may configure additional payment methods (cash, in-store card, etc.).
OrderQuik acts as a technology intermediary and does not directly process or store credit or debit card data. PayPal payments are handled entirely through PayPal's secure infrastructure.
In the event of payment disputes, partial or full refunds, and voidings, these will be managed by the corresponding restaurant through the platform.
6. Cancellation and Refund Policy
- Orders may be cancelled before they are confirmed by the kitchen (status "pending" or "received").
- Once an order is "preparing," cancellation is subject to the restaurant's policy.
- Refunds may be full, partial, or void, depending on the nature of the cancellation.
- The restaurant will record the refund reason and corresponding type on the platform.
- Refund processing times depend on the payment method used (PayPal may take 3 to 5 business days).
7. Bill Request and Payment Behavior
Customers who request a bill at a table must complete the corresponding payment. The restaurant may record unpaid bills with the appropriate justification. Persistent non-payment behavior may result in service restrictions.
8. Franchise Subscriptions
Franchise owners may subscribe to service plans that include different levels of functionality:
- Freemium: Basic functionality with limits on products, tables, and users.
- Basic, Pro, Premium: Advanced features such as POS, inventory management, advanced analytics, custom branding (white-label), and priority support.
Subscriptions are billed on a recurring basis through PayPal. Cancelling a subscription allows usage until the end of the paid period, after which the account is automatically downgraded to the Freemium plan.
9. Intellectual Property
All content, design, code, trademarks, and materials of OrderQuik are the property of OrderQuik and are protected by applicable intellectual property laws. Users may not copy, modify, distribute, or create derivative works without express authorization.
Content uploaded by restaurants (logos, menu images, descriptions) is the responsibility of each franchise.
10. Limitation of Liability
- OrderQuik acts as a technology platform intermediary and is not responsible for the quality, safety, legality, or availability of food and beverages offered by restaurants.
- We do not guarantee uninterrupted service availability or the absence of technical errors.
- We are not liable for losses resulting from service interruptions, errors in orders processed by the restaurant, or issues with external payment providers.
- Estimated wait times are approximate and may vary based on restaurant demand.
11. Acceptable Use
Users agree to:
- Not use the platform for illegal or unauthorized purposes.
- Not attempt to access other users' accounts or data.
- Not interfere with the operation of the platform or its security systems.
- Not place fraudulent orders or provide false information.
- Not share access credentials (table PIN, passwords) with unauthorized persons.
12. Service Availability
OrderQuik is available through:
- Mobile application (iOS and Android).
- Web application accessible from any modern browser.
- In-restaurant table access system via QR code and PIN.
We reserve the right to perform scheduled maintenance that may temporarily affect service availability.
13. Languages
OrderQuik offers bilingual support (English and Spanish). The franchise determines the default language, and menus may include descriptions in both languages.
14. Modifications to Terms
We reserve the right to modify these Terms and Conditions at any time. Changes will be published on the platform with a new version number. Continued use of the service after the publication of changes constitutes acceptance of the modified terms.
15. Governing Law and Jurisdiction
These terms are governed by the applicable laws in the jurisdiction where the franchise operates. Any disputes will be resolved in the competent courts of that jurisdiction.
